Terms & Conditions

Things you should know before placing an order.

By placing orders to register items on this website it will mean that you agree to be bound by the most current version of the Sales Terms. These Sales Terms apply to all contracts between you and us. We may change these Sale Terms at any time. If we make any changes to these we will include a notice on the Home Page and you should then check the changes. You accept that you will have no claim for breach of contract or otherwise in respect of any such alteration.

These Sales Terms were last updated on 01 January 2016.

 

Interpretation


"we", "us", "our", means Compare Aquatics Limited of 10 Wellington Street, Cambridge, CB1 1HW.

"you", "your" means the person ordering products under these Sales Terms.

"working days" means all days other than Saturdays, Sundays, and Public Holidays.

“items" means the website store/banner/article/product listings you have ordered from us, for instance an aquatics store item options (Basic, Premium or Featured).

 

1. Registration

 

1.1 In order to purchase items from this website, you need to register your details with us. On registration, you must provide us with accurate, complete registration information and it is your responsibility to inform us of any changes to that information (including in particular your email address) by updating your details in the “My Account” section.

1.2 You are responsible for all use of your ID and for preventing unauthorised use of your ID. If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of your ID or any payment information you must notify us immediately by contacting us at Admin@CompareAquatics.com.

1.3 Your registration does not in itself entitle you to receive acceptance to our website, and we are not obliged to accept any or all entries that you place with us. We reserve the right to refuse your registration and cancel your status without notice and for any reason. In this instance we will refund the monthly fee pro rata for the unexpired term. When we cancel your affiliate status because of a breach of these terms or the Terms of Website Use no refund will be made.

1.4 Following a refusal of registration, you are welcome to reapply at a later date. However if any subsequent application for registration remains in breach of our Terms of Website Use for any item within a 12-month period this will result in a £25 fee. This fee will be reduced from your item refund. This is to cover payment and administration costs or reinstating your PayPal refund.

 

2. Formation of contract

 

2.1 Any items or elements of the Compare Aquatics website with which you engage (creation of a profile, writing of articles, involvement in blogs, or creation of banner adverts) constitute an offer by you to fully accept our terms as laid out in clause 1.3, and will form a contract upon receipt of consideration from us in the form of email verification. Once your account registration has been received by our online system, we will have 24 working business hours to verify its content in line with clause 1.3.

 

2.2 If you have paid for your item registration you will receive an email receipt from our third party payment scheme, in this instance PayPal.

 

2.3 Once our staff verifies your account you will receive an account verification email in consideration of the formed contract. You will then gain full access to the administration panel for your user profile where you will be able to update your own details whenever you wish.

2.4 Where the use of the items is stated to be subject to any instructions or warnings, they are supplied on the condition that such instructions or warnings will be strictly adhered to in our Terms of Website Use.

 

3. Prices

 

3.1 All prices for the items are exclusive of taxes.

3.2 All items are subject to availability and may be changed at the company’s discretion at any time.

 

4. Payment

 

4.1 Payment authorisation must be provided by you on the date that you place an order for items. Payment must be made by credit/debit card or through our PayPal gateway. We accept payment by Visa, MasterCard, Switch, Maestro, Solo, American Express and Delta. Payment will be debited from your account each month with accordance to the item you’ve chosen.

4.2 On some occasions, we are required by the card issuer to perform additional security checks on the payment card, which can delay the order until the card has been authorised.

4.3 You confirm that the credit/debit card that is being used is yours.

4.4 All prices are shown in UK pounds sterling exclusive of VAT. Your payment card company will perform any currency conversion, if necessary.

 

5. Privacy

 

5.1 We will only use the details supplied by you in accordance with our Privacy Policy.

 

6. Cancellation of items

 

6.1 You may cancel your subscription at any point by contacting Compare Aquatics administration team. However, your subscription will not stop running until the last day of the date of your subscription period. If you require that your listing be immediately removed, you can email us at admin@CompareAquatics.com.

 

7. Limitations of liability

 

7.1 Under no circumstances, including negligence, shall we or any affiliated company or individual be held liable for any direct, indirect, incidental, special or consequential damage (including, without limitation whether for loss of profit, loss of business, lost data, viruses that may infect your computer, depletion of goodwill or otherwise), costs, expenses or other claims for economic loss (howsoever caused) which arise out of or in connection with the Contract or your use of this website generally.

7.2 We further do not warrant that the website or the products and materials contained on such site are error free, or that errors will be corrected, or that this site or the server from which it is run is free of viruses or other potentially harmful codes.

7.3 Our employees and agents are not authorised to make any representations or give any warranty concerning the items unless we confirm these in writing. In entering into the Contract you acknowledge that you do not rely on and waive any claim for any breach of any representation or warranty, which is not so confirmed.

 

8.  General

 

8.1 Our failure to insist upon the strict performance of any of your obligations under the Sales Terms will not be construed as a waiver and will not affect our rights to require strict performance of such obligations.

8.2 If any provision of the Sales Terms or part thereof is found to be invalid or unenforceable, the invalidity or unenforceability of such provision or part will not affect any other provision or the remainder of the provision in which such invalid or unenforceable part is contained, which will remain in full force and effect.

8.3 All notices will be in writing and maybe served by either party on the other by hand or by first class pre-paid post. The address for service, in the case of a notice from you to us, is specified at the bottom of this page and, in the case of a notice from us to you, will be the address stated on your order.

8.4 Nothing in these Sales Terms which form the agreement between you and us will give nor is intended to give rights to any third party under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

8.5 This website may provide links to the web sites and services of third parties. Such links are provided for your convenience only, and their provision does not constitute or imply control of or an endorsement of the content of such third party web sites by us. You acknowledge that the use of such third party web sites is governed by the terms and conditions of use as applicable to such websites.

8.6 These terms and conditions will be governed by and construed in accordance with English law and the parties will submit to exclusive jurisdiction of the English courts.

8.7 Neither we nor our affiliates make any representation that materials on this website are appropriate or available for use in locations outside the United Kingdom, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this website from other locations do so on their own initiative and are responsible for compliance with local laws.

2.1 Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

2.3 If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.

2.4 You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your Internet connection are aware of these terms, and that they comply with them.

10.1.2.8 be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;

10.1.2.9 promote any illegal activity;

10.1.2.10 be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;

10.1.2.11 be likely to harass, upset, embarrass, alarm or annoy any other person;

11.2 We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks.
